San Antonio Truck Rollover Lawyer
70 years of experience fighting for Texans injured in truck accidents
Truck rollover accidents are extremely dangerous. Often, the truck rollover causes other accidents, as any vehicles in the path of the truck or near the truck try to avoid the truck. Truck rollovers can become extremely dangerous if any cargo from the truck spills onto the highway.
At Pat Maloney: Accident & Injury Attorney, we represent drivers, passengers, and families when a truck rollover accident happens. We are skilled at showing how the truck rolled over and why the rollover should not have occurred. Our record of strong truck accident results on behalf of folks in and around San Antonio includes:
- $6 million for severe truck accident injuries.
- $3.1 million for a truck accident victim who required back and neck surgery.
- $2.75 million for the family of a Good Samaritan who was run over by an 18-wheeler truck.
How dangerous are truck rollover accidents?
The Insurance Institute for Highway Safety reported that in 2021, 7,640 people died in rollover accidents involving both trucks and other vehicles. About three-quarters of rollover accidents were “associated with a pre-rollover impact.” About one-quarter were not due to any impact. “The proportion of occupant deaths involving a rollover was much higher in single-vehicle crashes (49 percent) than it was for multiple-vehicle crashes (13 percent).” These numbers include cars, trucks, and SUVs.
What are the causes of truck rollover accidents in San Antonio?
Rollover accidents in San Antonio can occur in many different ways:
- Single-vehicle accidents. Here, the truck flips over after striking a curb, a barrier, or just due to the physics combination involving the center of gravity of the truck, the speed of the truck, and the direction of the truck. Spilled cargo can cause a truck driver to lose control of the truck, causing a rollover.
- Multiple-vehicle accidents. Here, the truck rolls over due to one or more collisions with other vehicles. A truck can roll over if it’s struck in the rear, side, or front. Rollover accidents can happen when a truck and another car are merging.
- Defective truck parts. Faulty brakes, malfunctioning steering, tire blowouts – any of these can ultimately cause a truck to roll.
- Construction work. Roads that are uneven, filled with gravel, or unfinished increase the odds of a truck rollover.
The most common cause for truck rollovers, however, is negligence:
- The driver loses control of the truck. The truck driver may lose control because he/she is:
- Driving while distracted – texting, speaking on a smartphone, eating, or doing anything to take the driver’s eyes off the road, hands off the wheel, and mind off of traffic.
- Driving while drunk or under the influence of drugs – the more alcohol someone drinks the more likely their ability to control their vehicle or respond to emergency situations will worsen.
- Driving while fatigued – falling asleep behind the wheel, or even just being too tired to see the road (or any potential hazards) can lead to a truck rollover.
- Speeding. Speeding is especially dangerous in curves. Truck drivers who speed may also roll their truck if they drive too fast over slippery surfaces
- Aggressive driving. Truck drivers or car drivers near a truck driver who switch lanes, speed, tailgate, or drive recklessly increase the risk their vehicle may flip over.
Some trucks are more prone to roll over than others based on their center of gravity. Some roads can increase the risk of a rollover – if they have too many long or steep curves, fail to allow enough room for the truck to maneuver, and for other reasons. Rural roads in particular can be dangerous for trucks because they’re usually single lanes, don’t have clear markers, and are also less likely to be well-lit.
What types of injuries do truck rollover accidents cause?
Truck rollovers put everyone at risk, from the truck drivers themselves to other drivers or even nearby pedestrians. The more severe injuries from a truck rollover accident can include:
- Traumatic brain injuries. Drivers and passengers are likely to hit the dashboard, the sides of the vehicle, and other people in the vehicle. They could even be ejected from the car. Truck drivers and occupants can also sustain head and brain trauma from the initial impact or as the truck rolls.
- Spinal cord damage and paralysis. If drivers and passengers/occupants are not properly restrained, there is a chance they could “bounce” off the sides of their own vehicle. But even with proper restraints, the risk of a spinal cord injury is great, especially if part of the vehicle is crushed.
- Traumatic amputation. Arms or legs may be severed due to the force of San Antonio rollover crash.
- Crush injuries. The occupants may suffer internal organ damage to their lungs, kidneys, and other organs, and internal bleeding as the impact harms their body from all sides.
- Broken bones. Many San Antonio truck accident victims will suffer simple, compound, complex, and multiple fractures.
